State Submission Requirements

  • Oldest RO in Days: 180
  • Number of Qualifying RO’s (a): 100
  • Or 90 Days of consecutive RO’s (b)
  • OEM Response – Days: 30
  • Increases Begins After OEM Receives submission unless disputing results – Days: 30

State Inclusion/Exclusions

  • Menu-priced parts or services.
  • Repairs for manufacturer or distributor special events.
  • Repairs covered by any insurance or service contract.
  • Vehicle emission or safety inspections required by federal, state or local governments.
  • Parts sold at wholesale or repairs performed at wholesale, which shall include any sale or service to a fleet of vehicles.
  • Engine assemblies and transmission assemblies.
  • Routine maintenance not covered under any retail customer warranty including, but not necessarily limited to, maintenance involving fluids, filters and belts not provided in the course of repairs.
  • Nuts, bolts, fasteners and similar items that do not have an individual part number.
  • Tires or Vehicle reconditioning.

Notes: If the State Statute does not specifically list the item as excluded, the OEM will use their own definition on what to exclude from the submission. Dealer may apply once per 12-month period.
