State Submission Requirements

  • Oldest RO in Days: 180
  • Number of Qualifying RO’s (a): 100
  • Or 90 Days of consecutive RO’s (b)
  • OEM Response – Days: 30
  • Increases Begins After OEM Receives submission unless disputing results – Days: 30

State Inclusion/Exclusions

  • Manufacturer or distributor special events, specials, or promotional discounts for retail customer repairs
  • Parts sold, or repairs performed, at wholesale
  • Replacement of tires or related elements
  • Routine maintenance that is not covered under a retail customer warranty, including the replacement of fluids, filters, and belts that are not provided in the course of other repairs
  • Items that do not have individual part numbers, such as nuts, bolts, and fasteners
  • Vehicle reconditioning
  • Accessories
  • Repairs of damage caused by a collision, a road hazard, the force of the elements, vandalism, theft, or operator negligence
  • Parts sold or repairs performed for insurance carriers
  • Vehicle emission or safety inspections required by law
  • Goodwill or policy repairs or replacements
  • Repairs for which volume discounts have been negotiated with government agencies or insurance carriers
  • Repairs performed on vehicles from a different line-make
  • Batteries replaced as part of a routine maintenance operation

Notes: If the State Statute does not specifically list the item as excluded, the OEM will use their own definition on what to exclude from the submission. Dealer may apply for parts and/or labor increase once per calendar year.
